Whereas,
it is essential that the people of Alabama
have faith and trust in their government; and
Whereas, our citizens are
best in a position to evaluate government and its workings when they
have full and complete access to information; and
Whereas, the information
currently available to the public does not include the disclosure of all
persons who stand to benefit from projects undertaken in the name of the
State.
NOW THEREFORE, based
upon considerations, and for other good and valid reasons which relate
thereto, I Don Siegelman, Governor of the State of Alabama, by virtue of
the authority vested in me by the Constitution and laws of the State of
Alabama, do hereby direct that all requests for proposals (RFP's),
invitations to bids (ITB's), contracts, proposals, and grant proposals
with the State of Alabama, shall include a disclosure statement
requiring a contractor or grantee to list any relationships of the
contractor/grantee or its employees, with public officials and public
employees, and family members of public officials and public employees
who stand to benefit from said contract, proposal, RFP, ITB or grant
proposal.
BE IT FURTHER ORDERED
that the disclosure statement shall include a description of any
financial benefit that may be gained by any public officials, public
employees, and family members of public officials and public employees
that may result either directly or indirectly from the contract/grant.
BE IT FURTHER ORDERED
that such disclosure statement shall also
require the contractor/grantee to list any and all paid consultants and
lobbyists for said contract, proposal, RFP, ITB or grant proposal.
BE IT FURTHER ORDERED
that the disclosure statement shall be developed by the Alabama Ethics
Commission.
BE IT FURTHER ORDERED
that one copy shall be
filed with the Alabama Ethics Commission and one copy shall be submitted
with the contract, proposal, RFP, ITB or grant proposal, and if the
disclosure statement pertains to a contract, a copy of the disclosure
statement shall be submitted to the Legislative Contract Review
Committee.
BE IT FURTHER ORDERED
that such disclosure statement shall be made under oath and penalty of
perjury.
BE IT FURTHER ORDERED
that to the greatest extent allowed by law, the State of Alabama will
not enter into any contract to appropriate any public funds with any
entity that refuses to provide such information.
BE IT FURTHER ORDERED
that this Executive Order shall become effective for any contract or
grant submitted on August 1, 2001 or thereafter, and shall remain in
effect until amended or modified by the Governor.
